By accessing or using the CareerAgent web app and making a purchase, you agree to these Terms and Conditions. Please read these terms carefully, as they contain important provisions that may limit liability, create obligations for the user, and should be understood fully.
The purpose of these Terms of Service is to govern the use of the CareerAgent web app and its AI-powered career assessment, which is exclusively intended for high school Grade 9 students.
Description: CareerAgent provides an AI-powered online career assessment designed to offer subject choice recommendations and potential career paths specifically for high school Grade 9 students.
Assessment Details: The assessment consists of 33 questions and includes the input of last report card marks. It is developed using various top AI models (e.g., ChatGPT 4.1, Claude Sonnet 3.7, Gemini 2.5), drawing insights from traditional personality and interest tests.
Session-Based Personalization & Data Handling: At the start of the assessment, users (Grade 9 students) may provide a name or nickname for the duration of that specific session. This information, along with assessment responses and inputted report card marks, is processed in real-time to generate personalized recommendations. No user accounts are created, and no students' personal information is saved by CareerAgent beyond the immediate assessment session.
Output: Upon completion, users can copy and download their generated report, which provides tailored recommendations.
Nature of Service: This is a digital guidance tool, providing recommendations based on the inputs provided during the session. It does not guarantee specific outcomes, employment, or academic success.
Access to the CareerAgent web app assessment is granted only after successful payment and confirmation of eligibility (age/guardian consent).
No user accounts are created on the CareerAgent platform. Users interact with the web app on a per-purchase basis.
Sole Target Audience: The CareerAgent web app is intended for use by high school Grade 9 students only.
Age Verification for Purchaser: Before proceeding to payment, the individual initiating the purchase will be prompted to confirm if they are "above 18 years of age."
Purchaser Confirmation & Guardian Consent:
Guardian Responsibility: A parent or legal guardian who provides consent and completes the purchase for a Grade 9 student affirms their legal capacity to do so and agrees to be bound by these Terms on behalf of the minor's use of the service.
Accuracy of Input: Users (Grade 9 students, with guardian consent) are responsible for the accuracy of the information they input during the assessment session, including the name/nickname provided, their answers, and their last report card marks.
Prohibited Use: [Lawyer to list prohibited activities, e.g., fraudulent purchase, interference with the service, distribution of unlawful material, unauthorized re-use of assessment content.]
Product Type: This is a digital product (a one-time purchase for access to the assessment).
Payment Gateway: Payments are processed securely via the PayStack payment gateway.
No Direct Storage: CareerAgent does not process or store credit card details directly.
[Lawyer to add clauses regarding pricing, payment methods, and a clear reference to the Refund Policy.]
Ownership: CareerAgent owns all rights, title, and interest in the CareerAgent web app, its underlying AI models, the assessment questions, the generated recommendations, and all associated content and trademarks.
Limited License: Upon successful purchase, users are granted a limited, non-exclusive, non-transferable right to access and use the CareerAgent web app and to copy/download their generated assessment report for personal, non-commercial use only.
[Lawyer to add standard IP clauses regarding copyright, trademarks, and strict restrictions on unauthorized reproduction, distribution, or reverse-engineering of the assessment content, algorithms, or the web app itself.]
"As Is" Basis: The CareerAgent web app and its assessment are provided "as is" without warranties of any kind, express or implied.
No Guarantees: Recommendations are advisory and based on the inputs provided (including name/nickname, assessment responses, and report card marks); they do not guarantee accuracy, specific outcomes, employment, or academic success. CareerAgent is a guidance tool, not a definitive predictor or guarantor of future success.
Virus/Malware: [Lawyer to add standard disclaimer regarding viruses, malware, etc., specific to web applications.]
[Lawyer to review and adapt Edukite's detailed disclaimers (Sections 9 & 10) to fit CareerAgent's service model, emphasizing the session-based and non-retained nature of the assessment data.]
CRITICAL: [Lawyer to draft comprehensive clauses limiting CareerAgent's liability for any direct, indirect, incidental, special, or consequential loss or damages which might arise from your use of, or reliance upon, the CareerAgent web app, its content, or your inability to use it.]
[Lawyer to include indemnification clause where users indemnify CareerAgent against any and all loss, claim, or damage arising from their misuse or breach of these terms.]
[Lawyer to include standard clause about CareerAgent's right to unilaterally amend these Terms and Conditions at any time. How changes will be communicated (e.g., by posting updated terms on the website) and that continued use constitutes acceptance.]
[Lawyer to include clauses about conditions under which CareerAgent may terminate or suspend access to the service (e.g., breach of terms, suspected fraud) with or without notice. Given no accounts, this would likely apply per-session or to future access from specific IPs if abuse is detected.]
Law: These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
